How recess (appointments) became a little less fun
If you ask any kid on the playground to define ?recess,? she?ll probably tell you that it?s the best time of the day. And for some presidents, recess has been met with as much relish. But that sentiment may now be in doubt, at least as far as presidents go. Because the definition of recess, it turns out, isn?t so clear.

No one needs to explain why a lunchtime recess at school is great. But as for what makes it great for the president, you?ll need to know a little background.
Article II, Section 2 of the Constitution grants the president power to nominate individuals to certain high-level positions in the federal government?but each nominee must be approved by two-thirds of the Senate.
There are about a thousand positions in the administration for which Senate confirmation is required, including all of the 15 Cabinet members who head executive departments, the heads of regulatory agencies (like the Environmental Protection Agency), ambassadors, Supreme Court justices and other federal judges, U.S. attorneys, U.S. marshals, deputy secretaries, undersecretaries, and assistant secretaries.
That?s a lot of people for the Senate to confirm. In addition to the sheer quantity, in the past few decades the Senate confirmation process has become increasingly contentious, with even lower-level nominations struggling through prolonged partisan battles.
But here?s why recess period is so much fun for the president, even if there is no swing set involved: Article II, Section 3 of the Constitution says that ?[t]he President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session.?
That means that the president doesn?t need to get Senate confirmation if he nominates someone when the Senate is recessed.
The tricky part is how to define a Senate recess. That?s what a recent federal court ruled on in a case about a handful of recess appointments by President Barack Obama.
In January 2012, President Obama appointed three members of the National Labor Relations Board when the Congress was on extended break for the winter holidays. Fearing that the president would attempt to make recess appointments, Republicans banged the gavel and officially opened a session for a few minutes every three days. The president argued that these sessions were simply a sham to cover what was actually a recess.
These sessions, which are called ?pro forma sessions? (from Latin, meaning ?as a matter of form?), are a recent development. They are typically brief, often lasting mere minutes and consisting of only a few senators or representatives, and held simply to avoid a recess and thus prevent any presidential recess appointments.
On January 25, a three-judge panel of the Circuit Court of Appeals for the District of Columbia was asked to consider the matter of whether the appointment of the three National Labor Relations Board was, in fact, a recess appointment and therefore not in need of Senate confirmation. The panel unanimously decided that the president did not have constitutional authority to make those appointments without confirmation. The court further stated, ?Considering the text, history, and structure of the Constitution, these appointments were invalid from their inception.?
As you can imagine, the president strongly disagrees with the decision. White House press secretary Jay Carney said of the decision, ?The decision is novel and unprecedented. ? It contradicts 150 years of practice by Democratic and Republican administrations.?
The case will likely go to the United States Supreme Court. If you were the court, how would you define a ?recess? by the Senate? And what should happen to the decisions made by the three-panel members during the year that they were in their positions while this case played out in court?
This case may not be as much fun as an hour on the monkey bars, but it is certainly a lot of fun for constitutional law lovers to watch unfold.

Our Director of Client Services, Jacek Rolnik, recently took some time from his busy schedule to talk about some of the challenges Onboard faces in 2013, as well as some of the things we are doing to improve our products and services.

What is Onboard?s client focus for 2013?
I think if I had to summarize our focus for the year in a few words, it would be ?back to basics.? This year we will continue to focus a lot of our energy on improving our core products, systems, and processing ? which includes adding in-house resources as well as better aligning tasks and functions with internal skill sets. This includes my team. We we also be enhancing our core data offerings by expanding coverage, increasing fill rates, and improving overall quality. The end goal is to provide exceptional service and experience and the most ?bang for the buck? for our clients.
What trends are we seeing in the marketplace?
I think real estate is ready to do great business again. I see companies across the board ready to compete and innovate like they did in the past. The ?online? real estate experience has changed greatly since we came onto the scene 10 years ago. Where it was previously limited to the website, it now includes an increasingly diverse set of touch-points connecting consumers and real estate companies and professionals. Today, these touch-points consist of websites, portals, tablet and mobile apps, social tools, CRM and lead gen tools, and much more. Consumers want ? and expect ? to see a similar experience across these channels. At present, I think the real estate industry by and large struggles to effectively deliver a multi-platform, consistent, and compelling brand experience to consumers. I think this is a huge opportunity for our clients and for Onboard. A recent NAR and Google report suggested that now nearly 90% of home shoppers use mobile search for their research and decision making process.
What is Onboard doing now to improve internal processes and content issues?
As I mentioned earlier, a key focus this year will be improving our core content, systems, and data processing. It?s no secret that we?ve experienced some challenges in recent months in the wake of Hurricane Sandy, a major data center move, and other compounding factors. We are definitely getting back on track and improving things along the way ? reexamining some internal processes ? and in some cases, tearing things down and starting over. We are also building in additional standardization, automation, and quality assurance measures, which we are confident will immensely improve the overall service and value we deliver to our customers. I?m confident in the direction we are going.

NY Times says Chinese hacked paper's computers
BEIJING (AP) ? Chinese hackers repeatedly penetrated The New York Times' computer systems over the past four months, stealing reporters' passwords and hunting for files on an investigation into the wealth amassed by the family of a top Chinese leader, the newspaper reported Thursday.
Security experts hired to investigate and plug the breach found that the attacks used tactics similar to ones used in previous hacking incidents traced to China, the report said. It said the hackers routed the attacks through computers at U.S. universities, installed a strain of malicious software, or malware, associated with Chinese hackers and initiated the attacks from university computers previously used by the Chinese military to attack U.S. military contractors.
The attacks, which began in mid-September, coincided with a Times investigation into how the relatives and family of Premier Wen Jiabao built a fortune worth over $2 billion. The report, which was posted online Oct. 25, embarrassed the Communist Party leadership, coming ahead of a fraught transition to new leaders and exposing deep-seated favoritism at a time when many Chinese are upset about a wealth gap.
Over the months of cyber-incursions, the hackers eventually lifted the computer passwords of all Times employees and used them to get into the personal computers of 53 employees.
The report said none of the Times' customer data was compromised and that information about the investigation into the Wen family remained protected, though it left unclear what data or communications the infiltrators accessed.
"Computer security experts found no evidence that sensitive e-mails or files from the reporting of our articles about the Wen family were accessed, downloaded or copied," the report quoted executive editor Jill Abramson as saying. A Times spokeswoman declined to comment further.
A Chinese Foreign Ministry spokesman called the Times' accusations groundless and reiterated the government's position that China also has been hacked repeatedly.
"To rashly jump to conclusions based on investigation results which have not been proved by evidence is totally irresponsible behavior," the spokesman, Hong Lei, said at a routine daily media briefing. "China is also a victim of cyber-attacks. Chinese laws specifically stipulate that cyber-attacks are prohibited."
The Chinese Defense Ministry asked for questions to be submitted in writing but initially declined comment.
The Times, in its report, quoted the Defense Ministry as saying that Chinese law prohibits hacking and other acts that damage Internet security and that accusing it of "cyber-attacks without solid proof is unprofessional and baseless."
China has been accused by the U.S., other foreign governments and computer security experts of mounting a widespread, aggressive cyber-spying campaign for several years, trying to steal classified information and corporate secrets and to intimidate critics. Foreign reporters and news media, including The Associated Press, have been among the targets of attacks intended to uncover the identities of sources for news stories and to stifle critical reports about the Chinese government.
"Attacks on journalists based in China are increasingly aggressive, disruptive and sophisticated," said Greg Walton, a cyber-security researcher who has tracked Chinese hacking campaigns. China's cyber-spying efforts have excelled in part because of the government's "willingness to ignore international norms relating to civil society and media organizations," he said.
The Times reported that executives became concerned just before the publication of the Wen investigation after learning that Chinese officials had warned of unspecified consequences. Soon after the Oct. 25 publication, AT&T, which monitors the Times' computer networks, notified the company about activity consistent with a hacking attack, the report said.
After months of investigation by the computer security firm Mandiant, experts are still unsure how the hackers initially infiltrated the Times' computer systems, the report said.
